These Terms of Use apply to your use of the Forge West website at forgewest.com.au. By using the site, you agree to these terms. If you do not agree, please do not use the site.

Forge West is operated by Oliver Gniel as a sole trader (ABN 42 194 384 262), based in Perth, Western Australia.

1. About this site

forgewest.com.au is a marketing website that describes our services, pricing, and contact details. It is not an online store and you cannot complete a transaction on the site. To engage our services, you must enter into a Master Services Agreement and Statement of Work with us.

2. Acceptable use

You agree to use the website only for lawful purposes. You must not:

  • Attempt to gain unauthorised access to any part of the site
  • Upload or transmit viruses, malware, or other harmful code
  • Use automated tools (scrapers, bots, crawlers) to extract content without our prior written consent
  • Reproduce, republish, or commercially exploit the content of the site without permission
  • Impersonate any other person or misrepresent your affiliation with any person or organisation

3. Intellectual property

All content on this site — text, graphics, logos, images, branding, design, code — is owned by Forge West or used under licence. You may view and briefly store content for your personal reference. You may not copy, modify, distribute, or use it commercially without our prior written consent.

“Forge West” and related branding are trading names used by Oliver Gniel.

4. Third-party links

The site may contain links to third-party websites (Google, Meta, ASIC, the ATO, etc.). These links are for convenience only. We do not endorse and are not responsible for the content, policies, or practices of any third-party site.

5. No professional advice

Information on the site is general in nature and does not constitute financial, legal, tax, or professional advice. Marketing results depend on many factors unique to your business. Before acting on anything you read on the site, you should seek advice appropriate to your circumstances.

6. Booking a call and submitting enquiries

When you submit the contact form or book a discovery call, you confirm that:

  • The information you provide is accurate
  • You are authorised to provide that information
  • You consent to us contacting you about your enquiry (see the Privacy Policy for how we handle your information)

Booking a discovery call does not create a binding engagement. A binding engagement is only formed when both parties sign a Statement of Work under our Master Services Agreement.

7. Availability

We try to keep the site available at all times, but we do not guarantee uninterrupted access. We may suspend, withdraw, or restrict access to all or part of the site without notice, including for maintenance or security reasons.

8. Limitation of liability

To the maximum extent permitted by law:

  • The site is provided “as is” without warranties of any kind, express or implied
  • We are not liable for any loss or damage arising from your use of the site, including indirect or consequential loss
  • Where liability cannot be excluded by law, our total liability is limited to the minimum permitted by that law

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law.

9. Governing law

These terms are governed by the laws of Western Australia. You submit to the exclusive jurisdiction of the courts of Western Australia.

10. Changes to these terms

We may update these terms from time to time. The current version is always available at forgewest.com.au/terms, with the “last updated” date at the top. Continued use of the site after an update means you accept the updated terms.
